Kingshiper Screen Mirroring Terms of Service

Introduction: Before using the Kingshiper Screen Mirroring App and services, please ensure that you fully understand and accept all the terms of this agreement (especially the disclaimer and liability limitation clauses). Otherwise, please do not register, log in, or use the services. By registering, logging in, or using the services, you indicate that you fully understand and accept all the terms of this agreement, especially the disclaimer and liability limitation clauses. Important content such as exemption or limitation of liability clauses will be highlighted in bold for your attention; please read them carefully. If you are under 18 years of age, please read and fully understand this agreement with the accompanying guardian and obtain the guardian's consent before using the Kingshiper Screen Mirroring App and related services.

Effective Date: 2024-04-30

1. Acceptance of Agreement

1.1 This service agreement (hereinafter referred to as "this Agreement") is an agreement reached between you (also referred to as "User") and Kingshiper Software Co., Ltd. (hereinafter referred to as "Kingshiper Software") regarding the services provided by the Kingshiper Screen Mirroring App software (hereinafter referred to as "the Software") that allows users to cast their phone screens to computers.

1.2 You confirm: Once you register as a user of the Kingshiper Screen Mirroring App or use the Kingshiper Screen Mirroring App software or services, you fully understand and agree to accept this agreement. If you are under 18 years of age, please read and fully understand this agreement with the accompanying guardian and obtain the guardian's consent before using the Kingshiper Screen Mirroring App software and related services.

1.3 You confirm: Kingshiper Software has the full authority to decide to change "this Agreement." If "this Agreement" changes, Kingshiper Software will announce it on the App homepage to notify users. If users do not agree to the changes, they must stop using the software and services; if users continue to use the software and services, it means that they unconditionally accept the revised agreement. The revised agreement will take effect immediately after being announced by Kingshiper Software.

1.4 This Agreement (including revised versions), the Kingshiper Screen Mirroring App privacy policy, and agreements or other documents related to the use of third-party software or technology with the Kingshiper Screen Mirroring software (if any) together constitute the complete agreement of the Kingshiper Screen Mirroring software and services and are legally binding on users and Kingshiper Software.

2. Service Content and Software Form

2.1 Service Content

Kingshiper Screen Mirroring App is a software that provides users with the function of casting their phone screen to a computer. Unless otherwise specified, any new features that enhance or strengthen the current services, including new products and additional services, will unconditionally apply this agreement.

2.2 Software Form

(1) Users may access the software through terminals such as computers, phones, in web page or client form. Specific information shall be based on what Kingshiper Software provides, and Kingshiper Software will continuously enrich the software's terminals and forms. When users use this software, they should choose a software version that matches their terminal and system; otherwise, users may not be able to use the software properly.

(2) In order to improve user experience, enhance service content, ensure the security of the software and consistency of functionality, Kingshiper Software will continually develop new services and has the right to update the software (these updates may take the form of software replacement, modification, feature enhancement, version upgrades, etc.), or change or restrict part of the software's functionality effects, or terminate or suspend the software and related services. After the new version of the software is released, Kingshiper Software does not guarantee that the old version of the software will continue to be available, and the corresponding customer service. Please check and download the latest version. Users fully understand and agree that Kingshiper Software has these rights and can exercise them without special notification to users.

2.3 Users fully understand and agree that the Kingshiper Screen Mirroring App software only provides the function of casting the phone screen to the computer to users, and that any devices related to the network service (such as personal computers, phones, and other devices related to accessing the Internet or mobile network) and the required fees (such as telephone charges and Internet access fees paid to access the Internet, and mobile phone fees paid to use the mobile network) shall be borne by users themselves.

3. Rules for Service Usage

3.1 Account Registration and Usage

(1) Account Registration. Users confirm that when registering or using services provided by Kingshiper Software in ways permitted by Kingshiper Software, you should be a natural person, legal person, or other organization with full capacity for civil rights and full capacity for civil conduct. If you do not have the aforementioned civil conduct capacity, you and your guardian should follow the law after your guardian's consent and registration by your guardian. Otherwise, you and your guardian shall bear any consequences resulting from it according to the law. After you successfully register, the software will provide you with a user account. The ownership of the user account belongs to Kingshiper Software, and you only have the right to use the user account. You may not gift, borrow, rent, transfer, or sell the account or allow others to use the account in any other way. You should properly keep the user account, and all actions taken through the user account will be deemed as actions taken by you. You shall be legally responsible for all activities and events under the user account and all consequences arising therefrom.

(2)Users promise that all information and data (referred to as "Information") provided during the registration and use of services provided by Kingshiper Software should be true and accurate. You should promptly maintain and update the Information, especially contact phone numbers, addresses, mobile phone numbers, and other contact information provided, to facilitate effective communication between Kingshiper Software and users. If there is a need to update the user's information, the user should follow the software's requirements or prompts to update. Users should bear all consequences resulting from the user-provided information being untrue, inaccurate, not updated, or unable to contact due to the information. Users shall bear all responsibilities and consequences resulting from this, including any losses or additional charges incurred during the use of services provided by Kingshiper Software, and should be completely responsible for it.

(3) If a user discovers that the account is being illegally used by others, they should immediately notify Kingshiper Software. Users fully understand and agree that Kingshiper Software is not responsible for the account being illegally used due to hacking actions or the user's negligence in keeping the account secure. Users understand and agree that any information known on the Internet may result in the account being illegally used, and both the user and their guardian understand and agree that this occurrence is not related to Kingshiper Software, and Kingshiper Software does not assume any responsibility for such occurrences. Users should bear full responsibility for any actions taken under their account and for the legal consequences of any action or activities for the integrity and privacy of the information.

(4) Users can cancel the previously registered account at any time. After the user cancels the account, Kingshiper Software will stop providing products and services that rely on the account login, and according to the user's needs, except as otherwise provided by laws and regulations, Kingshiper Software will delete or anonymize the user's personal information. Therefore, users understand and agree that after canceling the account, Kingshiper Software will not be able to recover any related information from the account. 

3.2 According to relevant laws and regulations, Kingshiper Software solemnly reminds users that any information, data, text, photos, graphics, or other materials (hereinafter referred to as "Content") uploaded, posted, emailed, or transmitted in any other way through our services, whether publicly or privately, are the responsibility of the content providers and sharers. Kingshiper Software cannot control the content shared through our services, so we do not guarantee the correctness, completeness, or quality of the content. Users are aware that when using our services, they may come across unpleasant, inappropriate, or offensive content. In any case, Kingshiper Software is not responsible for any content, including but not limited to any errors or omissions in the content, as well as any losses or damages arising from posting, sending emails, or otherwise transmitting any content through our services. However, Kingshiper Software has the right to stop the transmission of any of the aforementioned content and take corresponding actions, including but not limited to suspending user access to all or part of our services, keeping relevant records, and reporting to relevant authorities.

3.3 When users broadcast content using the Kingshiper Screen Mirroring App, they must comply with relevant national laws and regulations and bear all civil, administrative, and/or criminal legal responsibilities resulting from inappropriate information they publish. The information created or published by users on the Kingshiper Screen Mirroring App (including but not limited to video content, registered usernames, images, etc.) must not contain any of the following content:

(1) Violates the basic principles established by the Constitution;

(2) Endangers national security, leaks state secrets, subverts state power, or undermines national unity;

(3) Harms national honor and interests, or attacks the party and government;

(4) Incites ethnic hatred or discrimination, or disrupts ethnic unity;

(5) Disrupts friendly relations between countries or regions;

(6) Violates traditional Chinese virtues, social morality, ethical principles, or socialist spiritual civilization;

(7) Undermines state religious policies, promotes cults, or feudal superstitions;

(8) Spreads rumors or false information, disrupts social order, or undermines social stability;

(9) Incites, organizes, or instigates terrorist activities, illegal gatherings, associations, demonstrations, protests, agitation to disrupt social order;

(10) Promotes obscenity, pornography, gambling, violence, terror, or inciting crimes;

(11) Insults or defames others, infringing on their legitimate rights;

(12) Violates others' image rights, name rights, reputation rights, privacy rights, or other personal rights;

(13) Uses uncivilized language such as vulgarities, insults, slander, threats, curses, etc.;

(14) Acts under the guise of illegal civil organizations;

(15) Violates others' legitimate rights, such as copyright and information network dissemination rights; (16) Contains other content prohibited by laws and administrative regulations.

3.4 Unless permitted by law or with prior written consent from Kingshiper Software, users are not allowed to engage in the following behaviors while using this software and services:

(1) Deleting information about copyright on this software and its copies;

(2) Engaging in reverse engineering, reverse assembling, reverse compiling of this software, or attempting to discover the source code of this software through other means;

(3) Maliciously boosting orders or illegally attacking the Kingshiper Screen Mirroring App network service, posing a threat to the stability of the Kingshiper Screen Mirroring App product;

(4) Using, renting, lending, copying, modifying, linking, reposting, publishing, establishing mirror sites, etc., content owned by Kingshiper Software or affiliated companies with intellectual property rights; (5) Copying, modifying, adding, deleting, attaching, running, or creating any derivative works from data released into memory on any terminal during the operation of this software, client-server interaction data during software operation, and necessary system data for software operation, in forms including but not limited to using plugins, add-ons, or third-party tools/services not authorized by Kingshiper Software to access this software and related systems;

(6) Modifying or falsifying instructions or data in the software operation, adding, deleting, altering the function or operation effect of the software, or operating or disseminating software or methods for the above purposes, regardless of whether these actions are for commercial purposes;

(7) Logging in or using Kingshiper products and services through third-party software, plugins, add-ons, systems not developed or authorized by Kingshiper Software, or creating, publishing, or disseminating such tools;

(8) Interfering with this software and its components, modules, and data by themselves or through authorized individuals, third-party software;

(9) Engaging in other behaviors not expressly authorized by Kingshiper Software.

3.5 Unless permitted by law or with prior written consent from Kingshiper Software, users are not allowed to engage in the following behaviors while using this software and services:

(1) Submitting, publishing false information, or impersonating or utilizing others' identities;

(2) Inducing other users to click on page links or share information;

(3) Fabricating facts, concealing truths to mislead or deceive others;

(4) Infringing on others' rights such as reputation, image rights, intellectual property rights, trade secrets, etc.;

(5) Promoting or cross-promoting using Kingshiper Software accounts and any features without written permission from Kingshiper Software, as well as through third-party operating platforms;

(6) Engaging in any illegal criminal activities using accounts or this software and services;

(7) Producing and disseminating methods/tools related to the above actions, or operating or spreading such methods/tools, regardless of whether these actions are for commercial purposes;

(8) Engaging in other behaviors that violate laws, and regulations, infringe on the legitimate rights of other users, disrupt the normal operation of products, or behaviors not expressly authorized by Kingshiper Software.

3.6 If a user violates any provision of this agreement, in order to maintain the image, reputation, and security of Kingshiper Software, Kingshiper Software has the right to delete the relevant information posted by the user, close the user's ID, and/or temporarily or permanently prohibit the user from posting information on the Kingshiper Screen Mirroring App for those who breach the agreement. At the same time, Kingshiper Software reserves the right to pursue the legal responsibility of the parties according to the law. Furthermore, Kingshiper Software shall not be held responsible for breach or other legal liabilities towards the original poster after taking corresponding measures such as removal, including not bearing compensation liability for damages caused to the original poster due to unsubstantiated infringement allegations.

3.7 Users are solely responsible for their actions on the Kingshiper Screen Mirroring App. If a user's behavior does not comply with this agreement, Kingshiper Software has the right to independently decide to immediately cancel the user's service account. If a user spreads and disseminates reactionary, pornographic, or other information that violates national laws on the Kingshiper Screen Mirroring App, the system records of the Kingshiper Screen Mirroring App may serve as evidence of the user's violation of the law.

4. Privacy and Confidentiality

4.1 Unless otherwise agreed in this agreement, Kingshiper Software will not disclose or disseminate user information to third parties without the user's consent. Kingshiper Software will take strict confidentiality measures to protect user information from unauthorized access, use, or disclosure.

4.2 Users understand and agree that, except for Kingshiper Software's fault, such as leaks due to natural disasters, theft, robbery, hacker attacks, etc., Kingshiper Software shall not be liable for data breaches.

4.3 Kingshiper Software is no longer bound by confidentiality in the following cases:

(1) User-provided information, voice, and text manuscripts are made public for non-Kingshiper Software reasons;

(2) Required by laws and regulations, administrative and judicial authorities, or other authorized agencies;

(3) Authorized by the user in advance;

(4) For finding, preventing, or handling fraud, security, or technical issues;

(5) To enforce relevant service agreements or this policy, safeguarding public interests;

(6) To protect the personal and property safety or other legitimate rights and interests of Kingshiper Software's customers, Kingshiper Software or its affiliates, other users, or employees for reasonable and necessary purposes.

4.4 Once a user chooses to use this service, it means that the user acknowledges and accepts the content of the Privacy Policy related to this service and the new versions of the Privacy Policy that Kingshiper Software may update and publish at any time.

5. Copyright

5.1 The copyrights and other related rights relating to this software (including all texts, graphics, user interfaces, visual interfaces, images, trademarks, logos, sounds, music, artworks, and computer codes contained in this software, including the design, structure, selection, coordination, expression, "interface look," and arrangement related to the aforementioned content) belong to Kingshiper Software and are protected by copyright, trademark, and/or other property ownership laws.

5.2 Kingshiper Software does not provide any guarantees or promises regarding the applicability and suitability for user purposes of this software. Additionally, Kingshiper Software does not bear any legal responsibility towards users or any third party in any form for damages, arising from delays, inaccuracies, errors, omissions in the transmission or delivery of all or part of the materials included in this software, or arising therefrom.

5.3 Subject to the user's compliance with this agreement, Kingshiper Software grants the user a personal, non-exclusive, non-transferable, limited right to use this software. The user may install, use, display, and run this software on the user's own terminal devices. However, without explicit prior written consent from Kingshiper Software, the user may not copy, reproduce, reprint, upload, publish, publicly display, encode, translate, transmit, or distribute any part or content of this software in any way for publication, distribution, or any other commercial purposes to any other computer, server, software, or other media.

5.4 All other rights not expressly granted in this agreement are still owned by Kingshiper Software, and the user must obtain written permission from Kingshiper Software to exercise these rights. Failure by Kingshiper Software to exercise any of the aforementioned rights does not constitute a waiver of that right.

6. Advertisement

6.1 Users understand and agree that as users use this product and services, Kingshiper Software will send promotional messages for other products to users, including but not limited to promotional messages for product promotions. Please understand that this may cause disturbances for the user. 6.2 Kingshiper Software fulfills obligations towards advertisers according to legal regulations and relevant cooperation agreements. However, the user should judge the ad information's truthfulness and be responsible for their judgments. Except where required by law, Kingshiper Software is not responsible for any losses or damages suffered by users from transactions made based on this ad information or content provided by the aforementioned advertisers.

6.3 Users agree that when encountering advertising information in this product or service, users should carefully judge its truthfulness and reliability. Except where specified by law, users should be responsible for transactions based on the ad information.

7. Third-Party Products and Services

7.1 when users use third-party products or services provided by this product, in addition to complying with this agreement, users should also abide by the third party's user agreement. Kingshiper Software and third parties are individually responsible for disputes that may arise according to the law and agreements.

7.2 if users use this product or request Kingshiper Software to provide specific services, this product may call third-party systems or support user access through third parties. The results of using or accessing are provided by the third party (including but not limited to services provided through plugins made by this software), Kingshiper Software does not guarantee the security, accuracy, effectiveness, and other uncertain risks of services and content provided by third parties. Any disputes and losses caused by this do not relate to Kingshiper Software, and Kingshiper Software does not assume any responsibility.

8. Disclaimer

8.1 The user explicitly agrees that they will bear all risks associated with using the Kingshiper Screen Mirroring App entirely on their own; and any consequences arising from their use of the Kingshiper Screen Mirroring App will also be borne by the user themselves, with Kingshiper Software not assuming any responsibility towards the user or any third party.

8.2 Kingshiper Software does not guarantee that the network services will necessarily meet the user's requirements, nor does it guarantee that the network services will be uninterrupted. Kingshiper Software does not provide any guarantees or assurances regarding the timeliness, security, or accuracy of the network services.

8.3 Kingshiper Software does not guarantee the accuracy and completeness of external links set up for the convenience of users. Additionally, Kingshiper Software does not assume any responsibility for the content on web pages linked by such external links that are not actually controlled by Kingshiper Software.

8.4 Kingshiper Software does not assume any responsibility for network service interruptions or other defects caused by force majeure or reasons beyond Kingshiper Software's control. However, Kingshiper Software will make every effort to minimize the losses and impacts on users caused by such circumstances.

8.5 Kingshiper Software does not guarantee the truthfulness, accuracy, and completeness of any information (referred to as "information") obtained by users from Kingshiper Software. Users must independently verify the authenticity and exercise caution to prevent risks when acting based on the aforementioned "information." For any transactions and/or behaviors not directly related to Kingshiper Software, Kingshiper Software shall not be held accountable for any direct, indirect, incidental, or consequential losses or liabilities for any reason.

8.6 The user agrees that Kingshiper Software shall not be held responsible for any losses incurred due to the quality defects of the following products or services provided to the user by Kingshiper Software:

(1) Various network services provided to users for free by Kingshiper Software.

(2) Any products or services gifted to users by Kingshiper Software.

(3) Various products or services attached to paid network services for users by Kingshiper Software.

(4) Unauthorized use or modification of user data.

(5) Any other matters related to the Jinzhou Screen Casting App.

9. Limitation of Liability

Users clearly understand and agree that for reasons including but not limited to profit, reputation, application, data loss, or other intangible losses, Kingshiper Software shall not assume any direct, indirect, incidental, special, consequential, or punitive compensation liability (even if Kingshiper Software has been informed in advance of the possibility of such compensation):

(1) The use or inability to use our services;

(2) The cost incurred for replacing any goods, data, information, services purchased or obtained from or through our services, received messages, or transactions made;

(3) Unauthorized access to or alteration of the user's transmissions or data;

(4) Any statements or conduct of any third party within our services, or other matters related to our services, except as expressly provided in this agreement.

10. Modification or Termination of Service

Kingshiper Software has the right to temporarily or permanently modify or terminate our services (or any part thereof) at any time, with or without notice. Users agree that Kingshiper Software shall not be liable to users or any third party for any modifications, suspensions, or terminations.

11. Termination Clauses and Breach of Contract

11.1 Users fully understand and agree that if Kingshiper Software finds or receives reports or complaints from others that the User violates relevant laws and regulations or the provisions of this agreement Kingshiper Software has the right to independently decide, without prior notice, according to the nature of user behavior and solemnly take various measures including but not limited to suspending or terminating the service, pursuing legal responsibilities, claiming compensation for all losses. Users understand that any violations of this agreement may cause Kingshiper Software incalculable damage (monetary compensation may not fully compensate for such damage), and agree that Kingshiper Software obtains any prohibitory remedies deemed necessary or appropriate in such cases. Such remedies supplement any other remedies that Kingshiper Software may have according to the law.

11.2 Users agree that Kingshiper Software can independently decide, without prior notice, to terminate users' access to this software for the following reasons including but not limited to: 

(1) At the request of government departments and judicial authorities; 

(2) Suspending or making significant modifications to this software or any service provided by this software; 

(3) Unexpected technical problems.

11.3 Users fully understand and agree that Kingshiper Software has the right to handle behaviors that violate relevant laws, regulations, or provisions of this agreement based on reasonable judgment, take appropriate legal actions and measures against users' illegal activities, report relevant information to the relevant authorities in accordance with laws and regulations, and users shall bear all legal responsibilities arising therefrom alone.

11.4 Regarding any penalties, judgments, mediations, claims, losses, liabilities, claims, or expenses (including but not limited to fines, compensation, indemnity, legal fees, litigation costs, appraisal fees, travel expenses, execution costs, etc.) requested by administrative agencies, judicial organs, or any third party against Kingshiper Software due to users' violations of laws, regulations, or provisions of this agreement in using this software or related to it, users agree to indemnify Kingshiper Software and its management personnel, directors, shareholders, predecessors, beneficiaries, employees, agents, subsidiaries, and affiliated companies for all losses and protect them from damages.

11.5 Users fully understand and agree that the measures taken by Kingshiper Software against users based on the above remedies will not result in Kingshiper Software assuming any breach or any other potential liabilities towards users. After Kingshiper Software chooses to terminate this agreement or stop services, Kingshiper Software is not obligated to retain any information in the user's original account or related to it.

12. Jurisdiction and Applicable Law

12.1 This Service Agreement shall be governed by the laws of the People's Republic of China in terms of its effectiveness, performance, interpretation, and dispute resolution.

12.2 Any disputes arising from the content or execution of this agreement should be resolved amicably through friendly negotiation. In the event that negotiation fails, all parties involved unanimously agree to submit the dispute to the People's Court in the jurisdiction where Kingshiper Software is located for litigation resolution.

13. Miscellaneous

13.1 During the use of the Kingshiper Screen Mirroring App, users may raise any inquiries, opinions, or suggestions through the built-in contact options within the app. The Kingshiper Screen Mirroring App team will provide timely feedback, but the obligation to respond should not exceed Kingshiper Software's reasonable capacity. Users are responsible for ensuring their contact information is viable to receive calls or messages from Kingshiper Software, and Kingshiper Software shall not be liable for any losses incurred due to failure to receive notifications.

13.2 If any provision of this agreement becomes wholly or partially invalid or unenforceable for any reason, the remaining provisions of this agreement shall remain valid and binding.

13.3 This software and services are only intended for use within the territory of China. Kingshiper Software shall not bear any responsibility for any consequences resulting from users using the software unauthorizedly outside of China.

13.4 This agreement shall come into effect from the date when the user agrees by ticking a box or signing online and successfully registers as a user of the Kingshiper Screen Mirroring App or actually uses the software or services provided by the app. Unless terminated by Kingshiper Software or the user loses the qualification as a user of the Kingshiper Screen Mirroring App, this agreement shall remain effective. Termination of this agreement does not exempt the user from the obligations and responsibilities they should bear according to this agreement or other relevant agreements or rules.
